IVF insurance rules by US state
Each state decides whether insurers it regulates must cover infertility treatment. This page lists every state and the District of Columbia A–Z, with the statute each rule cites, the date that statute page was last read, and what each state’s Medicaid program covered as of January 2020. It describes the rules; it does not score them.
State rules do not reach self-funded employer plans
State fertility coverage requirements apply to insurance the state regulates. They do not apply to health plans an employer funds directly (self-funded plans), which federal ERISA rules govern instead. KFF.
71% of workers with employer coverage were enrolled in self-funded plans (KFF Employer Health Benefits Survey 2026; source, read 26 October 2026). Check the plan’s Summary Plan Description before assuming a state mandate applies.
How each row was checked
21 of 51 jurisdictions have a statute recorded here that addresses infertility coverage. Each cited statute page is re-read monthly and its text compared with the first read.
9 of 21 cited statute pages were read with unchanged text (latest read 26 October 2026).
The rest were blocked, did not load, or loaded a page without the statute’s wording; their details are shown with the date they were recorded by hand.
